E&O Submittal Update
Beginning February 1, 2023, Select Health will no longer require agents and agencies to submit proof of Errors & Omissions (E&O) coverage on an annual basis. Proof of coverage will be required at initial appointment and per the agent/agency contract, agents must always maintain coverage (detailed below) to remain appointed with Select Health. Select Health may still request proof of E&O coverage on an ad-hoc basis. The following contract language outlines agent/agency responsibility.
Agent agrees to provide a high level of customer service and support to Agent’s customers. Agent agrees to actively and in good faith promote Select Health products, plans, and services in regard to initial sales, customer support, and renewals. Agent will indemnify Select Health in full against any loss of money or of property, including any incurred costs and/or expenses which Select Health sustains through any fraudulent or dishonest act or culpable negligence on Agent’s part or on the part of anyone working for Agent, including but not limited to any acts identified in 2.4 in the agent contract, listed below.
Agent will at all times maintain the following insurance types and coverages:
A .comprehensive general liability insurance: $1,000,000 per claim, $2,000,000 annual aggregate;
B. privacy and data security breach insurance: $1,000,000 per claim;
C. errors and omissions insurance: $1,000,000 per claim; and
D. workers’ compensation insurance: statutory limits, if applicable.
Agent will provide evidence of such coverage to Select Health prior to selling the first group or individual policy for Select Health. All such coverage will be maintained in force after such dates as long as this Agreement is in effect and until the expiration of the statute of limitations applying to each insured event, and Agent’s authority to act as an agent for Select Health will be suspended any time such coverage is not in effect.
Agent agrees to abide by and conduct themselves with honesty and integrity, in accordance with guidelines that may be promulgated and modified by Select Health’s Agent Newsletter from time to time, and in all other respects according to law.
