TERMS OF USE

Scope

The following terms of service ("Terms") govern your use of Select Health’s APIs and other developer services (collectively, APIs). By accessing or using Select Health APIs, you are agreeing to the terms below.

Accounts/Registration

If you are using the APIs on behalf of an entity, you represent and warrant that you have authority to bind that entity to the Terms and when you accept the Terms, you are doing so on behalf of that entity (and all references to “you” in the Terms refer to you and that entity).

As part of the process to access the APIs, you will be asked to provide certain information (such as identification or contact details) as part of the registration process for the APIs, or as part of your continued use of the APIs. Any information you give to Select Health must be accurate and up to date and you must inform Select Health promptly of any future updates so that we can keep you informed of any changes to the APIs or the Terms, which may impact your use of the APIs. You will not be able to proceed with Patient Access API setup until you provide all the necessary information for an access request.

The Patient Access API is made available to permit third-party applications to retrieve data with the approval of those who have enrolled in Select Health coverage. You are only allowed to access the API for this permitted purpose. Select Health may deny registration and access requests that fail to align with this purpose or may deny or discontinue access to mitigate risks to the security of protected health information or Select Health systems.

Developer credentials (such as passwords, keys, tokens, and client IDs) issued to you by Select Health are intended to be used only by you and to identify any software which you are using with the APIs. You agree to keep your developer credentials confidential and make reasonable efforts to prevent other persons or entities from accessing or using your developer credentials. You agree to notify us immediately if you believe that your credentials have been discovered or used by another person or entity.

You may only access (or attempt to access) the APIs by the means described in the documentation of those APIs. If Select Health assigns you developer credentials, you must use them with the applicable APIs. Select Health may revoke your developer credentials for inappropriate use as determined by Select Health.

If you are granted production application credentials for the APIs, you may only use those credentials with the application that passed the production access review process. Select Health may revoke your production application credentials if you use or attempt to use them with another application or product that has not been reviewed and approved by Select Health.

Privacy

You must comply with all applicable Federal (e.g., FTC, HIPAA), Tribal, and State (e.g., privacy and consumer protection) laws regarding the protection and disclosure of information obtained through a Select Health API. You will adhere to the specifications and requirements set forth in the following guidance:

  1. CARIN Code of Conduct
  2. FTC privacy and security recommendations
  3. CMS’s recommended best practices
  4. ONC Model Privacy Notice

Additionally, you will abide by your application’s notice of privacy practices or privacy policy.

Right to Limit

Your use of the APIs will be subject to certain limitations on access, calls, or use and limited to locations with the United States, as set forth within these Terms or otherwise provided by Select Health. These limitations are designed to manage the load on the system, promote equitable access, and prevent abuse, and these limitations may be adjusted without notice, as deemed necessary by Select Health. If Select Health reasonably believes that you have attempted to exceed or circumvent these limits, your ability to use the APIs may be temporarily or permanently blocked. Select Health may monitor your use of the APIs to, for example, improve the service or to ensure compliance with these Terms.

Service Termination

If you wish to terminate your agreement with these Terms, you may do so by refraining from further use of the APIs. Select Health reserves the right (though not the obligation) to terminate access based on the CMS Interoperability Rule and regulatory guidance. You may petition Select Health to regain access to the APIs through the support email address provided by Select Health for the APIs. If Select Health determines in its sole discretion that the circumstances which led to the refusal to provide the APIs or terminate access to the APIs no longer exist, then Select Health may restore your access. All provisions of these Terms, shall survive termination, including, without limitation, warranty disclaimers, and limitations of liability.

No Warranties, Disclaimer of Liability, Indemnity by You

  1. WHILE INTERMOUNTAIN HEALTHCARE AND SELECT HEALTH TRY TO KEEP THE INFORMATION ON THIS SITE ACCURATE AND CURRENT, WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, CORRECTNESS, USEFULNESS, OR APPLICABILITY OF ANY MERCHANDISE, PRODUCT, INFORMATION, OR OTHER DATA OR ITEMS APPEARING ON THIS SERVICE. NEITHER INTERMOUNTAIN HEALTHCARE NOR SELECT HEALTH IS LIABLE TO YOU, OR TO ANY USER OF THIS SERVICE, FOR ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON THE MERCHANDISE, PRODUCTS, INFORMATION, CONTENT, OR OTHER ITEMS PRESENTED ON THIS SERVICE.
  2. NEITHER INTERMOUNTAIN HEALTHCARE NOR SELECT HEALTH DOES ANY OF THE FOLLOWING:
    • MAKES ANY EXPRESS OR IMPLIED WARRANTY, REPRESENTATION, OR ENDORSEMENT (INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE OR NONINFRINGEMENT, OR ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE) REGARDING THE MERCHANDISE, PRODUCTS, INFORMATION, OR OTHER CONTENT OR ITEMS APPEARING ON THIS SERVICE;
    • WARRANTS THAT ANY DOWNLOAD FROM THE SERVICE WILL BE FREE OF ANY VIRUS, WORM, TROJAN HORSE, OR OTHER DATA ALTERING OR CONTAMINATING COMPONENTS (YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE TAKEN STEPS TO PREVENT CONTAMINATING COMPONENTS FROM INFECTING YOUR COMPUTER AND ITS DATA);
    • IS LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ANY OTHER MONETARY OR OTHER DAMAGE, FEE, FINE, PENALTY, OR LIABILITY ARISING OUT OF OR RELATING IN ANY WAY TO THIS SERVICE OR TO ANY SITE ACCESSED THROUGH THIS SERVICE, OR FOR THE CONTENT OR INFORMATION ON THIS SERVICE OR ON ANY OTHER SITE (IF YOU ARE DISSATISFIED WITH THIS SERVICE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING THE SERVICE); OR
    • GUARANTEES CONTINUOUS OR UNINTERRUPTED ACCESS TO THIS SERVICE – OPERATION OF THIS SITE MAY BE INTERFERED WITH BY FACTORS BEYOND OUR CONTROL.
  3. YOU AGREE TO INDEMNIFY INTERMOUNTAIN HEALTHCARE AND SELECT HEALTH AND HOLD THEM HARMLESS—AS WELL AS THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, INFORMATION PROVIDERS, AND SUPPLIERS—FROM AND AGAINST ALL LOSSES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEY'S FEES, RESULTING FROM YOUR USE OF THIS SERVICE OR YOUR VIOLATION OF THE TERMS OF USE, OR BOTH.
