CAA Gag Clause Confirmation of Compliance
The Consolidated Appropriations Act (CAA) of 2021 requires group health plans and health insurance issuers to submit gag clause prohibition compliance attestations annually. Select Health has completed a thorough review of its agreements to ensure compliance and has taken the following steps
1. Submitted the required attestation for Fully Insured and Level Funded customers
2. Provided a Confirmation of Compliance for self-funded customers to support their own attestation process
Select Health agents may share the following branded documents with customers:
Select Health attests that the administrative services provided to self-funded customers comply with the requirements outlined in the Consolidated Appropriations Act, 2021 (PL 116-260), Division BB, Section 201: Increasing Transparency by Removing Gag Clauses on Price and Quality Information.
Action Required:
The annual attestation deadline is December 12, 2025.
You may use the Confirmation of Compliance to support attestations for any Select Health-administered medical, pharmacy, and behavioral health services.
The Department of Health and Human Services (HHS) has provided a portal and instructions for issuers and customers to complete their attestation via CMS. Be sure to follow the instructions available on the CMS site.
Your Select Health representative may have already provided a copy of the Confirmation of Compliance.

Wellness Rewards Program — Important Year-End Deadlines for Your Clients
Please remind your clients that in order to receive credit for Gym Membership or Physical Activity Rewards, all eligible activities must be entered on their selecthealth.org account by November 30. This includes gym information as well as activity tracking data submitted to Personify Health.
Wellness Rewards Program points accumulate from January through December and reset each January. Members can redeem points monthly or save them to exchange for higher-value gift cards*. The final day to redeem points is November 30.
*Rewards received may be considered income and subject to tax.
2026 Materials Now Available in Select Health Link
Updated materials for the 2026 plan year are now available in Select Health Link under Agent Resources. You can download them for immediate use or request printed copies to be shipped directly to you or your clients.

Level Funded Training
If you missed our first Level Funded Training, we have additional trainings scheduled. Join us for a focused training session designed exclusively for agents in Utah, Idaho, and Colorado to explore Level-Funding and the Select Health product in depth.
There are several trainings available in the months of November and December; please register for the date and time that works for you. The content will be the same in each meeting. There is no need to register for multiple sessions.

Behavioral Health Access Centers
Intermountain Behavioral Health Access Centers provide immediate behavioral health crisis care for members (18+) who are not experiencing medical emergencies. Visit Intermountain’s website for a full list of access centers.
Virtual Behavioral Care (Connect Care)
Virtual visits may cost members less than appointments at an in-person clinic. Intermountain Connect Care Behavioral Health is available in Utah, Idaho, Colorado, Nevada, and Montana. Members can schedule online through Intermountain’s website.
Employee Assistance Program (EAP)
The EAP offers members short-term counseling services to support them with personal or work-related stressors. While this free counseling is not diagnostic, it is available to all employees and their eligible family members (spouse/partner/dependents age 6-26) whose employer participates in this program. Members can call 800-538-5038 to confirm eligibility.

Virtual Intensive Outpatient Program (IOP)
UCHealth’s Virtual IOP provides structured group therapy online for members facing challenges with work, school, or daily life. Sessions are held three times a week for six to eight weeks. Members can join through a UCHealth provider, by self-referral, or by calling 970-266-4144.
